I. Application and enforceability of the general terms and conditions of sale
1.1. These general terms and conditions of sale are brought to the attention of each customer to enable them to place an order.
1.2 Consequently, placing an order implies the customer's full and unreserved acceptance of these general terms and conditions of sale.
1.3. No special conditions or other general conditions emanating from the client may, without the express agreement of Swisschocolate-online.com, prevail over the present conditions.
1.4. Any contrary condition posed by the client will therefore, in the absence of express acceptance, be unenforceable against Swisschocolate-online.com regardless of when it may have been brought to its attention.
1.5. The fact that Swisschocolate-online.com does not avail itself at a given moment of any of the present general conditions of sale, cannot be interpreted as a renunciation to avail itself at a later date of any of the said conditions.
II. Order taking and confirmation
2.1. The client undertakes to fill in the order form accurately and to complete the various existing sections (address, delivery address, method of payment, etc.). In the event of an error in the recipient's details, Swisschocolate-online.com cannot be held responsible for the impossibility of delivery to the recipient. The re-routing of the parcel to another recipient or to a new delivery address will be invoiced according to the destination and the weight of the order.
2.2 Each product request is subject to acceptance by Swisschocolate-online.com, which reserves the right to reject any order due to insufficient stock, incomplete customer information, or for any other legal reason. We undertake to inform you within two (2) working days following your order, if we encounter a problem in honouring your order.
2.4. Once the order has been paid for, no changes or cancellations can be made and the price paid will not be refunded.
III. Prices
3.1. The prices indicated on the order form are in Swiss Francs (CHF), all taxes included, ex our company. Swiss VAT of 2.6% on products and 8.1% on packaging and delivery costs apply to orders placed on the order form.
3.2. Delivery charges are extra. Delivery charges depend on the destination and the weight of the parcel. Above 10 kg, delivery prices are given as an indication and may be adapted on a case-by-case basis. Please contact Swisschocolate-online.com directly.
3.3. Import taxes: Any taxes and customs duties to be paid are the responsibility of the recipient and are payable on delivery.
IV. Payment with order
4.1. Payment is made online by credit card: Visa, Eurocard/Mastercard, Paypal.
4.2. The currency used for the transaction is the Swiss Franc (CHF). The amount debited from the account of the bank card used will depend on the rate of the CHF on the day of the debit and any exchange charges levied by the bank issuing the card.
4.3. In order to be registered, the order must be paid for in full. Unpaid orders cannot be delivered.
4.4. The invoice corresponding to the order placed is available in the "My Account" section.
V. Unavailability of products
The availability of products and services is given on the site as an indication only. It only becomes definitive once the order has been confirmed. In case of unavailability of a product Swisschocolate-online.com undertakes to offer a similar product to the client
Swisschocolate-online.com cannot be blamed for the unavailability of a product in the delivery, insofar as the client has been informed (via email) prior to the delivery of his order.
VI. Preparation and delivery of products
6.1 Parcels are prepared and packaged by Swisschocolate-online.com in closed, strong packaging that is appropriate for the contents and transport requirements.
6.2 THE CUSTOMER IS RESPONSIBLE FOR THE NAME AND ADDRESS OF THE PERSON TO BE DELIVERED TO, WHICH MUST BE ACCURATE AND COMPLETE (DOOR CODE, FLOOR, TELEPHONE, ...) to allow delivery under normal conditions. Swisschocolate-online.com cannot be held responsible for a return delivery due to an address error or the impossibility of delivering to the address indicated. IF THE RETURN DELIVERY OR THE IMPOSSIBILITY TO DELIVER IS DUE TO A LACK OF INFORMATION OR AN ADDRESS ERROR, THE RE-DELIVERY WILL BE INVOICED AT THE PRICE OF THE TRANSPORT PREVIOUSLY PAID.
6.3 PLEASE NOTE: Orders indicating a P.O. Box address will not be accepted.
6.4. Swisschocolate-online.com, after confirmation of the order, undertakes to process and deliver the order to the agreed destination, according to the route, procedure and carrier chosen. Swisschocolate-online.com relies on the general terms and conditions of the chosen carrier and cannot insure the goods to the place of delivery beyond what is offered by the carrier. It is the responsibility of the recipient to check the package in the presence of the delivery person. Any anomaly upon delivery must be noted on the delivery note. If this clause is not complied with, no reimbursement procedure with the chosen carrier can be initiated.
6.5. IN CASE OF ABSENCE OF THE RECIPIENT OR OF A PERSON WHO CAN TAKE POSSESSION OF THE PRODUCTS DURING THE DELIVERY, THE CARRIER WILL LEAVE A NOTICE OF PASSAGE at the delivery address indicated by the client inviting him to collect the products. Under no circumstances can Swisschocolate-online.com be held responsible for any deterioration of the products due to their late collection from the carrier, nor for any loss due to the non-recovery of the parcel.
6.6. The logistics centre for the preparation of orders is located at the following address: Swisschocolate-online.com - Nyon - Switzerland.
6.7 Swisschocolate-online.com cannot be held responsible if the product has not been delivered for the following reasons: force majeure as defined by the courts and natural disasters.
VII. Complaints - Disputes
7.1. Complaints or disputes will always be received with attentive benevolence, good faith always being presumed on the part of those who take the trouble to explain the dispute.
7.2. On receipt of the products, the customer must check that the delivery conforms to the order. Any damage must be the subject of precise, dated and signed reservations on the delivery note.
7.3. Any complaint must be made within a maximum of 24 hours after receipt, to the customer service of Swisschocolate-online.com, by email, via the form located in the "Contact" section. After this time, no complaint will be taken into account.
7.4. Swisschocolate-online.com may ask that the complaint be accompanied by proof of the damage suffered (waybill, photo of the parcel received, etc.). After analysis and acceptance of the complaint by Swisschocolate-online.com, the client may choose between a refund of the order or a re-delivery.
VIII. Returns
8.1. All product returns must be the subject of a formal agreement between Swisschocolate-online.com and the client and must be returned within 3 days of the agreement. After this period, no returns will be accepted.
8.2. Any return accepted by Swisschocolate-online.com, in the case of an apparent defect or non-conformity of the products delivered, which will be noted by Swisschocolate-online.com, will allow the client to obtain a free replacement to the exclusion of any other compensation or damages.
IX. Right of access and rectification

When you make a purchase, we only ask you for the information that is essential (surname, first name, full address, e-mail) for quality processing and careful follow-up of your order. The data you enter online is stored on a secure server and is immediately encrypted.
X. Guarantees
10.1 The BBD (Best Before Date) of our chocolates is indicated on the bottom of each box. Swisschocolate-online.com guarantees the quality and freshness of its products provided they are kept in a cool place (between 14 and 20°C), away from direct light.
10.2 Product information such as ingredients and nutritional information is regularly updated. As changes may be made to formulations at any time, we recommend that you regularly consult the list of ingredients on the packaging and read the allergy information.
